OBJECTIVE

The Prisons Administration System is an important part of the Criminal Justice System. The main objective of Prison Administration is to provide all facilities to detained prisoners while protecting their human rights as per the Uttar Pradesh Prison Manual. Along with, for betterment of their life provision of Moral Education and Professional Training has also been made, so that prisoners here should not take prison as some Torture House instead they should feel that this is some reformatory house for them, where they could get themselves improvised and can get entertained by the refreshment programs of prison.

DEPARTMENT SPECIFICATIONS, ACTS AND DUTIES

Under Prison Act 1894 and Uttar Pradesh Prison Manual the major responsibility of Prison Department is to ensure the safety of detained convict and concerned male, female, minor convicts and children residing with female convicts in the prisons of state. Along with to organize various programs of reform, welfare, personality rehabilitation, development and rehabilitation of prisoners, according to the current reformist policies of the government and get them benefited. Prison Administration is dedicated for the execution of above responsibilities.

DEPARTMENTAL ORGANISATION

In Prison Department three-tier organisation exists, which consists of Prison Headquarter, Zonal Office and Divisional Office, who all executes all their responsibilities properly. Brief description of their working is given below:-

Headquarter Organisation

Currently, as the Head of the Department, the post of DGP / Inspector General of Police has been taken over by Shri Chandra Prakash, Senior IPS office on June, 2018 For the assistance of Head of the Department along with Additional Inspector General Prison (प्र0), Additional Director General Prison (वि0), Deputy Inspector General (Headquarters), Finance Controller, Senior Superintendent (Headquarter), Superintendent Prison (Headquarter), Executive Engineer, Director Karagaar Udhyog, Research Officer, Finance and Accounts Officer, Assistant Engineer, Agriculture Officer, Additional Statistical Officer and OSD (Human Rights) 18 Sections and 03 Cells are formed.

Zonal Organisation

For monitoring the supervision of various prisons and various activities of the state, the state has been divided into 09 prisons zones (Agra, Meerut, Bareilly, Lucknow, Allahabad, Varanasi, Kanpur, Faizabad and Gorakhpur). Every zone is kept under administrative control of Senior Departmental Office of Deputy Inspector General level. At Zonal Level, for the execution of Administrative work, Stenographer, Clerk and Employees of Fourth Classes are being deployed.

Divisional Organization

For the instant solution of problems regarding establishment of employees of Department power for the appointment Security Cadre and Fourth Category Employees has been given to Senior Superintendent of Divisional/Central Prisons. For assistance of Senior Superintendent posts of Jailor, Deputy-Jailor, Security Personnel in addition to Clerk, Assistant Accountant, Urdu Translator, Educationist, Technical Staff are being formed. For the Medical facility of the prisoners, posts of Doctors (Senior Advisor, Advisor), Pharmacist and other Paramedical Staff have been formed. For the execution of all the above duties, posts of Senior Superintendent is being formed at Central Jail Varanasi, Naini (Allahabad), Bareilly, Agra, Fatehgarh and Adarsh Karagar Lucknow and at district prison of Divisional Prison Azamgarh, Basti, Banda, Faizabad, Gonda, Gorakhpur, Moradabad, Saharanpur, Meerut, Jhansi and in recent time posts of Senior Superintendent has also been formed at District Prison Lucknow and District Prison Aligarh.

Rights and Duties of Officers and Employees of Prison are being provisioned under Prison Act and Uttar Pradesh Prison Manual. Each and every responsibility and duty of officers and employees are mentioned in Prison Manual. Printed copy of Prison Manual is available for general public. Prisoners are also facilitated with this Manual.

• In case of any decision to be taken at the headquarters level, the first concerned panel is presented on the recommendation / proposal letter by examining it in the context of the updated rules by then Panel Assistant (Clerk). Afterward Supervisory Staff (Senior Clerk/Senior Assistant/Office Superintendent) also conducts testing and mention their opinion/intention. Afterwards in decision making process, other intermediate Officers/Employees also give their opinion/intention after testing and in the end at the decision making process (Head of Department) takes the decision in Manual. Afterwards essential and needed decisions are being issued.
• At zone level, cases are being represented in front of Deputy Inspector General, Zone by Ministerial Staff and orders are being received.
• • For the execution of various government works at prison level, cases are being presented for orders by the staff subordinate to the officers in charge and after work done over those cases by In-Charge Officer, orders are being received from Senior Superintendent/Superintendents of Prisons. At prison level, to receive expected orders from zone level, cases are being forwarded to Headquarters for expected orders from Zonal Offices and above Headquarter level.

Total 82 prisons institutions are being operated in department for successful operation of Prison Administration as per the policy of government. In these institutions 01 Prison Headquarter, 09 Zone Offices and for providing training to Prison Workers 01 Training Institute and one Jail Depot for sale and exhibition in general public of prison products are being included. Total 71 prisons are established in Uttar Pradesh in which 05 central prisons, 61 district prison, 2 sub-jails, 01 woman prison (Nari Bandi Niketan Lucknow) and 02 special prison (Aadarsh Karagar Lucknow and Kishore Sandan, Bareilly) are being included. For operation of government workings, total 10129 posts are being formed in various service cadre. For the successful operation of working for above mentioned prisons, it is being tried to consume maximum capability and experience of approved manpower. At every level, it is being ensured that every provision of rules and prison manual should be followed, so that a disciplined and transparent administration could be established.

For the operation of Prison Department, all proceedings and works, all guidelines are being mentioned in the Prison Manual. In the Department, responsibilities of Inspector General, Deputy Inspector General, Senior Superintendent, Superintendent Prison, Jailor, Deputy Jailor and Security Cadre and of other Cadre are being mentioned in Uttar Pradesh Prison Manual. Therefore, one can receive concern of rules for execution of work of officers and employees of Prison Department as mentioned in Uttar Pradesh Prison Manual.

Working of Prison Administration is of specific nature. From the entrance in prison till the release, various proceedings take place. While prisoners are kept in jail, it is the duty of administration to ensure their security and to organise several training and reformation programs for the betterment of the prisoners. For each work separate registers are maintained in which every related entry is made. In prisons, freedom fighters were also detained. All important documents related to these are kept safely in the prison. From historic point of view, various reports and returns are also kept safe.

Regarding departmental policy formation and its working, Prison Stable Committee for department is being formed for consulting with public members and meeting of this committee is being organised from time to time.

Provision for board of visitors has been made in Prastar-674 of Uttar Pradesh Jail Manual in Prison Department.

Besides this, for proceedings of premature release of prisoners, following boards/committees has been formed, which are not open for the outsiders:-

• Probation Board is formed for giving opinions and recommendations on cases of premature release of convicted prisoners.
• Those prisoners who are not benefited of premature release on form-A, form them Advisory Committee is formed for releasing them on nominal role.
• Revising Committee is formed for premature release of prisoners under chapter-10 of Jail Manual.
• Committee has been formed at government level for concern over case of petition of mercy for the premature release of prisoners. This Committee presents recommendation to Hon’ble Governor for release over cases of mercy petition of prisoners.
• To provide rehabilitation, welfare and profession to the prisoners in prison, Welfare and Cooperative Committee has been formed.

After the meeting conducted by above committees and boards, general public can receive its meeting minutes.
